Date of Publish 28th January 2011

Artjunkie Clothing has successfully prevented a number of retail outlets from selling counterfeit copies of their Hustle bear creation. The Hustle bear design, featuring an proteceted iconic crown and money bag, has been copyrighted for many years and is also protected under trademark law. The similarities between the Artjunkie design and the counterfeit items being sold were so close that they infringed upon the rights of Artjunkie clothing,

Following the identification of the counterfeit design in multiple stores by Artjunkie customers, Artjunkie promptly issued a number of N1 claim forms. In response, the company initiated the removal of the counterfeit items from sale in numerous stores, including Burton, Topman, Icon Fashion, and other retail outlets.

All retailers acknowledged their failure to conduct adequate checks with their Chinese suppliers to verify the trademark or copyright of the design. Artjunkie expressed gratitude for brands like Topman, which acted swiftly.

The company also lamented the cutthroat nature of the fashion industry, highlighting the challenges faced by smaller brands in competing with larger entities and condemning unfair usage.
